A teacher’s aide in New York City is caught between the justice system and the New York City Department of Education since a grand jury on Monday declined to indict him on child sexual abuse charges.

Though the aide, Brett Picou, 30, of Public School 52 in Springfield Gardens, Queens, is free from criminal charges, the Education Department has kept him off the payroll and could still seek to discipline or fire him. Mr. Picou is the second teacher’s aide this spring to be left in limbo after such charges were dropped.

Mr. Picou’s case “is under review by the D.O.E., and he remains suspended without pay,” said Marge Feinberg, a spokeswoman for the Education Department.
